These Terms of Use (“Terms”) govern your access to and use of the website located at https://montgomery-advisory.com and any related client portal or online service (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Website Ownership

The Site is owned and operated by Montgomery Advisory, LLC, a Maryland limited liability company (“Montgomery Advisory,” “we,” “us,” or “our”). All content, features, and functionality are provided by or on behalf of Montgomery Advisory.

2. Permitted Use of the Site and Client Portal

You may use the Site for lawful purposes related to learning about our services, submitting a consultation request, communicating with our team, and — where access has been granted to you — exchanging documents and information in connection with an active engagement. Client portal credentials and secure links are issued to a specific individual or organization and may not be shared, transferred, or used by anyone else.

Information presented on the Site is general in nature and does not constitute accounting, tax, financial, investment, or legal advice. No client relationship is created by visiting the Site or submitting a form. A client relationship begins only upon execution of a written Engagement Letter by both parties.

3. Intellectual Property

All text, graphics, logos, page layouts, service descriptions, document templates, and other materials on the Site are the property of Montgomery Advisory or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Montgomery Advisory name and logo are our trademarks. You may view and print pages for your personal or internal business reference, but you may not reproduce, republish, distribute, modify, sell, or create derivative works from Site content without our prior written permission.

4. No Unauthorized Access or Misuse

You agree not to:

  • Access or attempt to access any account, portal area, secure link, or system that has not been provided to you.
  • Probe, scan, or test the vulnerability of the Site or circumvent any security or authentication measure.
  • Use automated means such as scrapers, crawlers, or bots to extract content or submit forms.
  • Upload or transmit any virus, malware, or harmful code.
  • Interfere with the operation of the Site or impose an unreasonable load on our infrastructure.
  • Submit false, misleading, or fraudulent information, or impersonate another person or entity.
  • Use the Site for any unlawful purpose or in violation of these Terms.

We may suspend or terminate access to the Site or client portal at any time if we believe these Terms have been violated.

5. No Guarantee of Uninterrupted Service

The Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be available without interruption, free of errors, secure from all threats, or that any defect will be corrected. Access may be suspended for maintenance, updates, or circumstances beyond our control. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the fullest extent permitted by law, Montgomery Advisory and its members, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of or inability to use the Site — even if advised of the possibility of such damages. Our total aggregate liability arising from your use of the Site will not exceed one hundred U.S. dollars (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law. Liability arising from professional services is governed by the applicable Engagement Letter, not by these Terms.

7. Governing Law

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. You agree that the state and federal courts located in Maryland will have exclusive jurisdiction and venue over any such dispute.

8. Electronic Communications

By using the Site, submitting a form, or corresponding with us by email, you consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Standard email is not a secure medium; please use the secure channels we designate when transmitting sensitive financial or tax information.

9. Electronic Signature Acknowledgment

Engagement letters, consents, and related documents may be executed electronically. By signing electronically, you acknowledge and agree that your electronic signature is the legal equivalent of your handwritten signature and is intended to authenticate the document and bind you to its terms, consistent with the federal ESIGN Act and the Maryland Uniform Electronic Transactions Act. You may request a paper copy of any electronically signed document by contacting us.

10. Third-Party Services

We use reputable third-party providers to support our operations, including DocuSign for electronic signature and Clover for payment processing. When you use these services, your interaction is also governed by the applicable provider’s terms and privacy policy. The Site may also link to third-party websites we do not control. We are not responsible for the content, availability, security, or practices of any third-party service or website.

11. Consultation Requests and Fees

Submitting a consultation request does not guarantee acceptance. Montgomery Advisory reviews each request and may decline an engagement at its discretion. The Business Consultation Reservation Fee compensates the time and preparation involved in the consultation and is non-refundable, including where you elect not to proceed with an engagement afterward. Fees for services are confirmed in writing before work begins.

12. Modification of Terms

We may revise these Terms at any time. Changes take effect when posted, and the “Last Updated” date above will reflect the most recent version. Your continued use of the Site after a revision constitutes acceptance of the updated Terms. This page remains at the same permanent address so that references from third-party providers continue to resolve correctly.
